Mr. Dash specializes in complex commercial litigation, with particular emphasis in matters involving bankruptcy and creditor's rights, business valuation, contracts, commercial torts, and defamation. He has represented creditors and equity security holders in a variety of major chapter 11 cases, as well as a wide variety of corporate and other institutional clients in commercial disputes.
Representative Matters
Representing various hedge fund clients in disputes and claims arising out of the collapse of Lehman Brothers.
Counsel to joint official liquidators of family of Cayman Island hedge funds prosecuting, in an ongoing multi-district litigation, claims seeking in excess of $300 million for fraud, misrepresentation, professional malpractice, breach of fiduciary duty, and conversion.
Litigated highly complex, multi-billion dollar valuation dispute resulting in recovery by equity holder clients of significant post-reorganization value.
Prosecuted to favorable settlement action seeking in excess of $270 million in damages for breach of contract, tortious interference, conversion, and related claims in connection with a breach of an investment advisory agreement. Successfully defeated a series of motions for summary judgment and for preliminary injunctions.
Lead trial counsel for multi-national shipping company in high-profile mutual insurance company coverage dispute relating to claims spanning a more than 50-year period that resulted in favorable settlement and ongoing client recovery.
Successfully represented major investor in chapter 11 debtor in defeating multi-million dollar professional fee claim, including appeal to Second Circuit Court of Appeals.
Successfully represented official committee of unsecured creditors in defeating a debtor plan to sell its assets that would have resulted in little or no recovery by unsecured creditors and prosecuted to confirmation an alternative plan of reorganization providing creditors with virtually all of the equity in the reorganized entity.
Successfully represented noteholder seeking to acquire major gaming asset through confirmation of a plan of reorganization and defeated confirmation of an alternative plan proffered by a competitor in highly contested proceeding.
Successfully represented Jersey Central Power & Light Company in multi-million dollar breach of contract, tortuous interference, and antitrust action, resulting in a highly favorable settlement immediately prior to trial.
