Biography

Virginie Colaiuta is a Partner based in our London & Paris Offices.  

She acts as counsel, advocate and arbitrator in international arbitration proceedings, also based on bilateral and multilateral investment treaties, under the rules of the ICC, LCIA, SCC, ICSID, UNCITRAL and the EDF (European Development Fund), in relation to disputes arising out of construction and energy projects.

Virginie is admitted to practise in England & Wales (English Solicitor), France (Avocat à la Cour) and New York, USA (Attorney at Law). Virginie has studied and worked in different languages (Italian, French and English) and in several jurisdictions such as Italy, France, Canada, USA and the UK. As a result of her training and working experience, she has an excellent understanding of the differences of civil law and common law rules applicable to construction and energy projects.

Her track record in the construction sector has led to her being  recommended as a leader in Chambers Global and Who’s Who Legal since some years. 

Virginie regularly lectures on conflict of laws and investment  treaty arbitration at the MSc programme of King’s College London.

She is presently the Publications Officer of the  International Construction Projects Committee  of the International Bar Association (“IBA”) and acts as Editor of the IBA law  magazine titled “Construction Law International”. 

Virginie has also been considered for appointments as arbitrator.

Representation

Counsel in an ICSID arbitration based on the Netherlands – Tunisia BIT following the alleged expropriation of a foreign investment in a State Tunisian bank.

Counsel in an Energy Charter Treaty arbitration following the alleged expropriation of an oil refinery located in Bulgaria.

Counsel in arbitration proceedings according to the European Development Fund (“EDF”) Rules relating to dispute concerning some construction road works realized in the Mwanza region in Tanzania.

Counsel to a State owned power utility of El Salvador in a UNCITRAL arbitration against an American investor resulting from the termination of a long-term power purchase agreement following the privatization of the production, transmission and distribution of electricity by the State. The damages claimed amounted to about US$ 140 million.

Counsel to a Latin American State power utility in UNCITRAL arbitration proceedings against an American company over the interpretation and performance of a settlement agreement on electricity transmission costs.

Counsel to a Brazilian oil company in a US$ 900 million dispute against the Libyan State agency the Great Man-Made River Project Authority relating to the drilling of wells to extract ground water from the subsoil of the Libyan desert.

Counsel to a Nigerian oil company in ICC arbitration proceedings arisen out of certain drilling contracts.

Counsel to an Italian company in arbitration proceedings against a Romanian State agency relating to a construction road project in Romania.

Counsel to two subsidiaries of a French contractor in arbitration proceedings relating to a construction project in Saudi Arabia.

Counsel to a Danish contractor in ICC arbitration proceedings against a German main contractor concerning a construction project in Trinidad.

Counsel in arbitration proceedings commenced by a Danish main contractor against an Italian subcontractor in relation to construction works at three airports in Mozambique.

Counsel to an Italian subcontractor against a Spanish main contractor regarding a dispute concerning the refurbishment of a power plant owned by a Puerto Rican State power utility.

Counsel to a Delaware corporation and its Danish subsidiary in an arbitration against a Chinese State owned company relating to various license agreements for the manufacturing of specialty chemicals for the steel industry.

Counsel to an American corporation against a Maltese company relating to a dispute arising out of two contracts relating to the dismantling of a steel industrial plant located in Ohio whose components were to be shipped to Ukraine.

Counsel to an Italian subcontractor against a Malaysian contractor regarding a dispute arising out of a contract about the sale of a specialist software program to be bought by a Malaysian State bank.

Counsel to a Korean company against a Swiss corporation in relation to the payment of a commission deriving from a sale procurement contract concerning electronic appliances.

Counsel to a Dutch corporation against a Delaware corporation in relation to a dispute arising out of a Satellite Service Agreement.

Counsel in a team representing an Asian State entity in procurement dispute with European defence contractor.

Counsel to an American pharmaceutical company against a Russian distributor.
