Our Government Law & Strategies Group works particularly close with our energy
team in recognition of the substantial political issues associated with many

municipal street lights. We represent energy service clients who combine sales
of electricity and natural gas to end users, and clients who provide financing
for energy conservation projects.
Scope of Services
Since the advent of deregulation, Brown Rudnick has increasingly represented
clients in the transactional and regulatory aspects of the acquisition and
divestiture of generation facilities. Among our accomplishments, we represented
the auction advisor for the Seabrook Nuclear Power Station. We also assist in
the development of merchant plants and in energy contracting matters.
We also actively represent regulated utilities. Recently, for example, Brown
Rudnick’s Energy Practice Group achieved notable success on behalf of regulated
utilities in proceedings before state regulatory bodies to obtain groundbreaking
performance based rate orders for two natural gas utilities.
In the course of representing power facility projects, Brown Rudnick also
applies expertise in lending, permitting, environmental, land use planning and
state and federal regulatory issues which arise in connection with the often
challenging siting of energy generation and transmission projects. Additionally,
members of the Practice Group also have considerable experience in the ongoing
operation of such facilities.
We also work with manufacturers of distributed generation equipment, including
micro-turbines and fuel cells, and with end-use customers in evaluating and
procuring distributed generation solutions.
In response to state mandates to increase renewable energy resources in the
region, as well as the creation of state-sponsored funds to encourage such
development, Brown Rudnick is in the forefront in working with clients to
develop and finance renewable energy projects, in both the US and the UK. Our
attorneys are experienced in renewable energy technologies, contracts for sales
and purchases of renewable energy credits (RECS), litigation over ownership of
RECS, and regulatory approvals of qualification for state renewable energy
portfolio standards.
In recent years, we have also applied this level of experience and perspective
to assist with restructuring and bankruptcy matters. Working closely with the
firm’s bankruptcy and litigation teams, our energy attorneys’ background
includes our work representing the Official Equity Committee in the Chapter 11
proceedings for Mirant Corporation, ranked as the 11th largest bankruptcy case
in US history. Mirant is one of the largest publicly traded merchant power
companies in the world.
Our energy attorneys are also experienced in syndications, tax-exempt bond
financings and energy tax credits.
